Terms of Service
These Terms of Service (“Terms”) govern access to ClaimCheck, including its Shopify application and website, provided by ClaimCheck (“ClaimCheck,” “we,” “us,” or “our”). By installing, accessing, or using ClaimCheck, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
1. Eligibility and authority
You must have legal capacity to enter a contract and authority to act for the Shopify merchant account that installs or uses ClaimCheck. You are responsible for your Shopify account, staff permissions, devices, and anyone who accesses ClaimCheck through your store.
2. The service
ClaimCheck provides focused service-ticket workflows in Shopify POS and Admin. Implemented functions include one free-text item description per ticket, service type, notes, optional due date and Shopify customer, sequential ticket numbers, search and status or location filters, four fixed statuses, a visual status timeline, and optional deposit and later balance-payment progress linked to Shopify orders.
ClaimCheck is not an accounting, invoicing, estimating, refund, inventory, technician-dispatch, communications, or customer-portal service. Features may change over time, and beta or pre-release functions may be incomplete.
3. Shopify and third-party services
ClaimCheck depends on Shopify services, including Shopify POS, Admin, APIs, customer and order records, app-owned metaobjects, authentication, and managed app pricing. Your use of Shopify is governed by your agreements with Shopify. ClaimCheck is not responsible for Shopify outages, changes, account restrictions, or third-party services outside our control. Shopify is a trademark of Shopify Inc.; ClaimCheck does not currently claim official Built for Shopify certification.
4. Merchant responsibilities
You are responsible for:
- Using ClaimCheck and Shopify in compliance with applicable laws and your customer commitments.
- Ensuring ticket descriptions, notes, customer links, due dates, statuses, and payment information are accurate and appropriate.
- Providing required privacy notices and obtaining any permissions needed to process customer information.
- Controlling staff access and promptly removing access when no longer needed.
- Maintaining appropriate records and backups for your business; ClaimCheck is not your sole accounting or record-retention system.
- Handling customer communications, service quality, estimates, approvals, taxes, refunds, disputes, and fulfillment.
5. Acceptable use
You may not misuse ClaimCheck, interfere with its operation, bypass access controls, reverse engineer the service except where law expressly permits, introduce malicious code, use it to violate law or third-party rights, or access another merchant’s information without authorization. You may not use the service for highly sensitive information unless we expressly agree in writing.
6. Fees, trials, cancellation, and refunds
ClaimCheck is offered for $19 per month with a 7-day free trial. Development and Shopify Partner stores are always free. Plan approval, billing interval, trial details, and subscription management are presented through Shopify Managed Pricing or the Shopify App Store listing before approval.
You may cancel through the available Shopify app-management or managed-pricing flow. Cancellation takes effect according to the terms displayed by Shopify. Except where required by law or expressly stated in the applicable Shopify billing flow, fees are non-refundable and we do not provide credits or prorated refunds for partial billing periods. Taxes and any Shopify-administered billing adjustments follow Shopify’s applicable processes.
7. Data and privacy
Our Privacy Policy describes how ClaimCheck handles information and identifies the service providers currently used to operate the website and application. Each party will comply with applicable data-protection obligations.
8. Ownership and feedback
ClaimCheck and its licensors retain all rights in the service, software, branding, documentation, and related materials. You retain rights in the information you or your customers provide, subject to the rights needed for us to operate the service. If you provide feedback, you authorize us to use it without restriction or compensation, provided we do not publicly identify you without permission.
9. Confidentiality
Each party will protect the other’s non-public confidential information using reasonable care and use it only to perform or receive the service. This obligation does not cover information that is public through no breach, independently developed, rightfully received without restriction, or required to be disclosed by law.
10. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. We may maintain, update, add, remove, or discontinue features. Where reasonably practicable, we will give notice of material changes that adversely affect paid use.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMCHECK IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TICKET INFORMATION, PAYMENT PROGRESS, OR THIRD-PARTY DATA WILL BE COMPLETE OR ERROR-FREE. NOTHING IN THESE TERMS EXCLUDES WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. CLAIMCHECK’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID CLAIMCHECK FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited or to liability that cannot legally be limited.
13. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless ClaimCheck from third-party claims, damages, losses, liabilities, costs, and reasonable legal fees arising from your unlawful use of the service, your ticket content, your services to customers, or your material breach of these Terms. ClaimCheck will provide reasonable notice of a covered claim, allow you to control its defense and settlement, and provide reasonable cooperation at your expense. You may not settle a claim in a way that admits fault by or imposes obligations on ClaimCheck without our prior written consent.
14. Suspension and termination
We may suspend or terminate access for material breach, security risk, unlawful conduct, nonpayment after any required notice, or where needed to protect the service or others. You may stop using and uninstall ClaimCheck at any time. Provisions that by their nature should survive will survive, including ownership, disclaimers, liability limitations, and dispute terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Subject to any mandatory rights that apply to you, the state and federal courts located in Maryland will have exclusive jurisdiction over disputes arising from or relating to these Terms or ClaimCheck, and each party consents to personal jurisdiction in those courts.
16. General
These Terms and incorporated policies are the entire agreement about ClaimCheck and replace prior discussions on that subject. You may not assign the Terms without our consent; we may assign them in connection with a reorganization or transfer of the service. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. Neither party is liable for delay caused by events beyond reasonable control.
17. Changes to these Terms
We may update these Terms. We will post the updated date and provide notice of material changes where required. Continued use after an effective update constitutes acceptance where permitted by law.
